PNG No Referendum Problem
The Independent State of Papua New Guinea (PNG) was created without gaining the free, prior and informed consent of the Native Tribes of PNG. The PNG Constitution also was also enacted without the free, prior and informed consent of the 800+ Native Tribes in PNG. This is a legal fact because there was never a referendum held to gain that consent from the 800+ Native Tribes involved.
This means that the PNG State and Constitution are not valid, they are unauthorized, and they are de facto. This means that all branches of the PNG Government have no true jurisdiction over any of the Tribes in PNG or any of the Members of those Tribes. This includes the PNG Court system.
If you are taken to court you can simply inform the judge that you do not recognize the authority of the court because the court has no jurisdiction because neither you or any of your Tribe Members ever gave consent to the PNG Government of the PNG Constitution to have authority over you.
All Native Tribes Members in jail can use this argument to appeal to have their charges dismissed and that they should be released immediately.
If a Government lawyer tries to argue against this than simply ask that Government lawyer to provide to the court proof that you or your Tribe agreed to be part of PNG or to be ruled over by the PNG Constitution. When that Government is not able to provide that evidence you will win in court.
For all resource owners in this country to reclaim ownership of your natural resources below six feet just take the Government to court and ask the Government to provide evidence that you or your Tribe gave your permission for the PNG Government and Constitution to claim your resources. Ask the Government to provide evidence that a referendum was conducted in your Tribe to gain that authorization and to provide the results of that referendum. When the Government is not able to provide that evidence you will win back ownership of your resources and you will be able to develop them yourselves and negotiate contracts with developers yourselves.
You also do not have to pay taxes because of this because you and your Tribe never agreed to pay taxes to the PNG Government.
